TÉRMINOS Y CONDICIONES DEL CONTRATO DE SERVICIOS DE HOSPEDAJE Y DE ESTANCIA TURÍSTICA EVENTUAL, EN LO SUCESIVO “EL CONTRATO”, QUE CELEBRAN POR UNA PARTE NOWNESS SA DE CV A QUIEN EN ADELANTE SE LE DENOMINARÁ “EL ANFITRIÓN”, Y POR LA OTRA “EL HUÉSPED” INDICADO EN LA “RESERVACIÓN”, COMO SE DEFININE MÁS ADELANTE Y QUE FORMA PARTE INTEGRANTE DEL CONTRATO, QUIENES DE MANERA CONJUNTA SE LES DENOMINARÁ COMO “LAS PARTES”, AL TENOR DE LAS SIGUIENTES DECLARACIONES Y CLAUSULAS:

D E C L A R A C I O N E S

I. Declara “El Anfitrión” que:

a) Es una persona moral legalmente constituida conforme a las leyes mexicanas, lo que se acredita con el testimonio de la escritura pública número 93,031 (NOVENTA Y TRES MIL TREINTA Y UNO) , 11/09/2022 de fecha, otorgada ante la fe de LUIS ANTONIO MONTES DE OCA MAYAGOITIA Notario Público número 29, en Ciudad de México e inscrita en el Registro Público de Comercio de Ciudad de Mexico bajo el número A202208171221577250, de fecha 22/12/2022, y que el Yosef Zonana en su carácter de representante legal, en este acto interviene con las facultades que se le confieren en el testimonio de la escritura pública número 93,031 (NOVENTA Y TRES MIL TREINTA Y UNO), de fecha 11/09/2022, otorgada ante la fe del LUIS ANTONIO MONTES DE OCA MAYAGOITIA, Notario Público número 29 del Ciudad de México, y que dichas facultades no le han sido revocadas, modificadas o limitadas a la fecha de firma de este Contrato.

b) Dentro de su giro se encuentra la prestación, por cuenta propia o de terceros, de servicios de Hospedaje y de Estancia Turística Eventual en inmuebles de uso habitacional, ya sean casas o edificios completos, o en sus habitaciones o apartamentos por separado (en adelante, individualmente designados como el “Inmueble”).

c) Su domicilio se encuentra ubicado en https://be.nowness-living.com/terms-and-conditions, lugar donde presta los Servicios de Hospedaje y de Estancia Turística Eventual materia del presente Contrato (en adelante, conjuntamente los “Servicios de Hospedaje”), mismo que señala como domicilio convencional para todos los efectos de este instrumento.

d) Se encuentra inscrito en el Registro Federal de Contribuyentes con la clave NOW220913GG4;

e) El Inmueble cuenta con instalaciones seguras e higiénicas y con las condiciones e insumos necesarios para prestar los Servicios de Hospedaje; así como con personal capacitado en la atención de hechos relacionados con actos de discriminación.

f) Se prohíbe negar, excluir o distinguir el acceso o prestación de los servicios a cualquier persona o colectivo social por el tono de su piel, origen étnico, nacional, raza, lengua, sexo, género, edad, discapacidad, condición jurídica, social o económica, identidad indígena, identidad de género, apariencia física, condiciones de salud, religión, formas de pensar, orientación o preferencia sexual, por tener tatuajes, perforaciones o cualquier otra razón que tenga como propósito impedir el goce y ejercicio de los derechos humanos.

g) Para atender cualquier solicitud o reclamación del Huésped, pone a su disposición el número telefónico: +525618738646 y el correo electrónico: nowness.living@gmail.com, con un horario de atención de las 07:00 horas a las 23:00 horas.

h) Adicionalmente, para la atención de quejas, denuncias y emergencias, el Huésped podrá ponerse en contacto con las autoridades competentes, a través de los siguientes medios:

- Emergencias. Teléfono: 911. Horarios: 24 horas.

- Área de atención telefónica acreditada por Gobierno de la Ciudad de México:

LOCATEL. Teléfono: 55-5658-1111. Horarios: 24 horas.

- Instituto de Verificación Administrativa de la Ciudad de México. Teléfono: 55-4737-7700.

- Correo electrónico: atencion.invea@cdmx.gob.mx. Horarios: Lunes a jueves de 9:00 a 18:00 horas. Viernes de 9:00 a 15:00 horas.

i) Ha informado al Huésped las características y las tarifas de los Servicios de Hospedaje, incluyendo los servicios complementarios; así como la tasa del Impuesto Sobre el Hospedaje aplicable en la Ciudad de México.

j) Ha dado a conocer al Huésped los términos y condiciones establecidos en el presente Contrato, así como las Reglas o Reglamento de uso del Inmueble, en adelante simplemente el “Reglamento del Inmueble”; documentos que se encuentran disponibles para su consulta y descarga, en el Inmueble y en el sitio web: https://be.nowness-living.com/terms-and-conditions.

k) Protegerá y tratará los datos personales del Huésped, únicamente con la finalidad de prestar los Servicios de Hospedaje y conforme a lo previsto en la Ley Federal de Protección de Datos Personales en Posesión de los Particulares. Para obtener más información sobre el tratamiento y protección de sus datos personales deberá consultar el aviso de privacidad, en el Inmueble y en el sitio web: https://be.nowness-living.com/terms-and-conditions.

II. Declara “El Huésped” que:

a) Es una persona física con capacidad legal y económica para obligarse en los términos del presente Contrato, y se identifica con el documento oficial que demuestra su mayoría de edad.

b) Tiene la ocupación, origen, procedencia y lugar de residencia señalados en la “Reservación”, como se define más adelante.

c) Manifiesta bajo formal protesta de decir verdad que tiene relación de parentesco, la tutela legal o bien la guardia y custodia de los menores de edad que lo acompañan (en su caso), como lo acredita con documento idóneo.

d) El Inmueble cuenta con instalaciones seguras e higiénicas y con las condiciones e insumos necesarios para el Hospedaje.

e) Conoce a satisfacción las características, instalaciones, ubicación, superficie, cupo, estado, accesorios, servicios y las áreas comunes correspondientes del Inmueble.

f) Conoce las tarifas de los Servicios de Hospedaje prestados por el Anfitrión en el Inmueble, incluyendo los servicios complementarios.

g) Conoce la tasa de los Impuestos aplicables, incluyendo el Impuesto Sobre el Hospedaje aplicable en la Ciudad de México, estando conforme con los mismos.

h) Conoce los términos y condiciones establecidos en el presente Contrato, así como el Reglamento del Inmueble; documentos que manifiesta haber leído y tener a su disposición.

i) Conoce el tratamiento y protección proporcionados por el Anfitrión a sus datos personales.

En virtud de las Declaraciones anteriores, “Las partes” convienen en obligarse conforme a las siguientes:

C L Á U S U L A S

PRIMERA.- CONSENTIMIENTO.- Mediante la confirmación de la reservación del Inmueble, efectuada por el Huésped ya sea directamente o a través de terceros, bien sea a través de Plataformas Tecnológicas o por medio de Agencias de Viajes en Línea (OTAs) debidamente autorizadas, o bien reservando directamente con el Anfitrión, o simplemente mediante la suscripción de la Hoja de registro del Inmueble (Anexo A), en adelante indistintamente la “Reservación”; las partes manifiestan su voluntad para obligarse de conformidad con este Contrato, obligándose el Anfitrión a poner a disposición del Huésped el Inmueble conforme a lo estipulado en la Reservación y el Huésped, a su vez, se obliga a pagar el precio cierto y determinado vigente al momento de realizarla, comprometiéndose a cumplir con todos los términos y condiciones del presente Contrato.

Todas las personas que se hospeden en el Inmueble, sin importar si la Reservación fue realizada por un Tercero, están sujetas a todos los Términos y Condiciones del presente Contrato por ese solo hecho, por lo que también serán Consideradas individualmente como Huésped, siendo corresponsables con la persona que realizó la Reservación, del cumplimiento de todas las obligaciones establecidas a su cargo en el presente Contrato.

SEGUNDA.- OBJETO.- El objeto del presente Contrato consiste en la prestación de Servicios de Hospedaje y de Estancia Turística Eventual en el Inmueble (“los Servicios de Hospedaje”), por parte del Anfitrión y en favor del Huésped, cuyas características y tarifas variables, de acuerdo a los precios del mercado, se indican tanto en los listados puestos a disposición del público en general a través de las páginas web y aplicaciones de las Plataformas Tecnológicas y las OTAs, así como en la Lista de Tarifas (Anexo C) que forma parte integral del presente Contrato, misma que se encuentra a disposición del público en general y del huésped tanto en el Inmueble, como en el sitio web: https://be.nowness-living.com/terms-and-conditions.

Las partes están de acuerdo en que los Servicios de Hospedaje no incluyen servicios complementarios, tales como servicios de venta de alimentos y bebidas; de aseo, de lavandería o planchaduría; de peluquería o spa; de oficina o coworking, de eventos o de entretenimiento; entre otros análogos que están sujetos a disponibilidad en cada caso y que se indican en la Lista de precios de Servicios Complementarios (Anexo D) para fines informativos; así como tampoco incluyen los servicios externos, proporcionados por terceros.

TERCERA.- TARIFA DEL HOSPEDAJE.- Las partes manifiestan su conformidad en que el precio a pagar por el Huésped, como contraprestación por los Servicios de Hospedaje, es el precio que le fue informado al momento de confirmar su Reservación o, en su caso, su modificación autorizada por el Anfitrión; y, en su defecto, es el que resulte de aplicar a las noches de estancia, los precios vigentes publicados en la Lista de Tarifas (Anexo C) puesta a disposición del Huésped (la “Tarifa del Hospedaje”).

A la Tarifa del Hospedaje, deberá agregarse el precio de los servicios adicionales de Hospedaje, indicados en la Lista de Tarifas (Anexo C), que sean devengados por el Huésped durante su estancia, en adelante la “Tarifa total del Hospedaje”; obligándose el Anfitrión a respetar todos los precios, sin que pueda cobrar al Huésped otros servicios sin su consentimiento.

El Huésped es responsable de cualquier Modificación que realice a la Reservación, aceptando pagar cualquier cantidad adicional, comisión o impuesto asociado a la misma.

CUARTA.- FORMA Y LUGAR DE PAGO.- El Huésped efectuará el pago de la Tarifa del Hospedaje, en moneda nacional, en el tiempo y modo estipulado en la Reservación, a través de los sistemas de pago de las Plataformas Tecnológicas o de las OTAs en su caso o, en su defecto, de forma directa al Anfitrión en el Inmueble, a más tardar en el día de su salida (“Check-out”).

El Huésped podrá realizar todos los pagos aplicables, de contado, con tarjeta de débito, tarjeta de crédito, transferencia electrónica de fondos o depósito bancario, debiendo comprobarlos, sin menoscabo de poder realizarlos en efectivo en moneda extranjera, al tipo de cambio publicado en el Diario Oficial de la Federación al día en que se efectúe el pago. Todos los pagos se entenderán recibidos salvo buen cobro.

El Huésped autoriza al Anfitrión a realizar una retención de fondos o preautorización en su tarjeta de débito o crédito, el día de su arribo (“Check-in”), para garantizar el pago de la Tarifa del Hospedaje, en caso de que no compruebe haberla cubierto ya, así como por concepto de depósito que garantice el pago de los servicios adicionales de Hospedaje y de los servicios complementarios, que llegara a requerir durante su estancia; así como los posibles daños que llegara a causar al Inmueble.

En caso de que el Huésped no compruebe haber cubierto el pago de la Tarifa del Hospedaje el día del Check-in o Durante su estancia no lo garantice en forma alguna, el Anfitrión estará autorizado para cancelar la Reservación y negarle el acceso al Inmueble, o desalojarlo.

El Huésped podrá realizar el depósito requerido, conforme al párrafo anterior, en efectivo el día del Check-in, en caso de que no cuente con otro medio de pago o el utilizado no sea suficiente, debiendo esperar para su devolución o liberación a la revisión que efectúe el Anfitrión de que no existan adeudos pendientes de pago, o daños por cubrir.

A más tardar el día del Check-out, el Huésped deberá haber cubierto la Tarifa total del Hospedaje y el precio total de los servicios complementarios.

No podrá el Huésped en ningún caso retener o condicionar el pago de la Tarifa del Hospedaje, de los servicios complementarios, o de cualquier servicio devengado, por ningún motivo ni bajo ningún título. Llegada la fecha de pago, se entenderá que el Anfitrion ha hecho el requerimiento de pago correspondiente al Huésped, en tiempo y forma, para todos los efectos legales.

El retraso en el pago de cualquier prestación a cargo del Huésped generará intereses moratorios a razón del 0.5% diario sobre saldos insolutos, hasta su total liquidación (los “Recargos”).

En caso de que el Prestador tenga que incurrir en alguna comisión bancaria derivada del método de pago elegido por el Huésped, la misma deberá de ser cubierta en su totalidad por éste.

En caso de existir algún adeudo a cargo del Huésped, el Anfitrión podrá aplicar el Depósito al pago del mismo hasta donde alcance, sin perjuicio de la subsistencia de su obligación de pago por el remanente.

En caso de negativa de pago por parte del Huésped, estará prohibido al Anfitrión retenerlo en su persona, debiendo solicitarse la intervención inmediata a las autoridades competentes y, conforme a lo establecido en el artículo 2669 del Código Civil para la Ciudad de México, el Anfitrión podrá retener en prenda su equipaje, hasta que obtenga el pago de lo adeudado.

QUINTA.- RECEPCIÓN Y SALIDA DEL HUÉSPED.- El Anfitrión entregará el Inmueble al Huésped entre las 16:00 (Dieciseis) Horas y a más tardar a las 18:00 (Dieciocho) horas del día de su arribo (“Check-in”), y el huésped deberá desocupar la habitación a más tardar a las 10:00 (Diez) horas del día de su salida (“Check-out”). El Huésped tendrá derecho a un periodo de tolerancia de 60 (sesenta) minutos a partir de la hora de salida para desalojar el Inmueble sin cargo alguno, en caso contrario deberá cubrir la tarifa vigente para esa noche o las noches adicionales que ocupe el Inmueble, de conformidad con la Lista de Tarifas (Anexo C). En todo caso, el Huésped acepta que el Anfitrión realice el cargo automático de la o las noches adicionales al Método de Pago registrado, habiendo transcurrido el periodo de tolerancia, sin perjuicio del depósito realizado.

SEXTA.- SERVICIOS COMPLEMENTARIOS Y EXTERNOS.- Como complemento de los Servicios de Hospedaje, el Anfitrión podrá proporcionar al Huésped, en el Inmueble, los servicios complementarios indicados en la Lista de precios de Servicios Complementarios (Anexo D), misma que se encuentra a disposición del Huésped para su consulta tanto en el Inmueble, como en el sitio web: : https://be.nowness-living.com/terms-and-conditions..

Dichos servicios, sujetos a disponibilidad en cada caso, podrán consistir en servicios de venta de alimentos y bebidas; de aseo, de lavandería o planchaduría; de peluquería o spa; de oficina o coworking, de eventos o de entretenimiento; entre otros análogos; y deberán ser autorizados por el Huésped de forma expresa en el Anexo A.

Los servicios externos, proporcionados por terceros, tales como servicios de agencia de viajes, tours o guías de turistas; de mensajería o delivery; de renta de autos, taxis o shuttles; entre otros análogos; que hayan sido difundidos por el Anfitrión con arreglo en colaboraciones comerciales, son de la exclusiva responsabilidad de quienes los presten, por lo que deberán ser autorizados expresamente por el Huésped y cubiertos directamente a los prestadores externos, de conformidad con sus propios términos y condiciones, deslindándose el Anfitrión de toda responsabilidad relacionada con éstos.

SÉPTIMA. RESTRICCIONES.- El Anfitrión vigilará que se conserve la seguridad de las personas y que no se ocupe el Inmueble para actividades que alteren el orden público o afecten el interés social, o para la posible comisión de un delito, en cuyos casos deberá dar aviso a las autoridades competentes.

Derivado de lo anterior, se encuentra estrictamente prohibido:

1. El Ingreso al Inmueble de menores de edad que no estén acompañados de quien acredite tener una relación de parentesco, su tutela, o su guarda y custodia; y de aquellos que no se registren.

2. El acceso al Inmueble con mascotas, salvo el caso de perros de asistencia o de compañía, sujeto a disponibilidad.

3. El acceso al Inmueble con todo tipo de armas.

4. Generar ruido que afecte a terceros.

5. Exceder la capacidad de aforo del Inmueble.

6. Fumar en el Interior del Inmueble y en todos los espacios cerrados de acceso al público.

7. El cruce de apuestas en el interior del Inmueble.

8. El lenocinio, pornografía, prostitución, consumo y tráfico de drogas, delitos contra la salud, corrupción de menores, turismo sexual, trata de personas con fines de explotación sexual.

9. La grabación o videograbación de contenido, video o fotografías comerciales dentro del Inmueble.

10. Dañar, modificar, alterar o intervenir en modo alguno el Inmueble, sus instalaciones, acabados o menaje.

OCTAVA. OBLIGACIONES DE LAS PARTES.

A. EL ANFITRIÓN SE OBLIGA A:

1. Confirmar la Reservación al Huésped, previa información de las características y las tarifas de los Servicios de Hospedaje, así como de cualquier servicio complementario.

2. Informar al Huésped sobre los términos y condiciones establecidos en el presente Contrato, y a cumplir con los mismos.

3. Informar al Huésped sobre el Impuesto Sobre el Hospedaje aplicable en la Ciudad de México.

4. Informar al Huésped sobre el Reglamento del Inmueble.

5. Informar al Huésped cualquier restricción o prohibición que aplique dentro del Inmueble.

6. No discriminar en forma alguna al Huésped.

7. Atender quejas, denuncias y reclamaciones del Huésped.

8. Permitir el acceso al Inmueble a personal autorizado por el Instituto de Verificación Administrativa, así como al personal de los cuerpos policiales en cumplimiento de una comisión.

9. Permitir el acceso al Inmueble a perros de asistencia.

10. Emitir y entregar al Huésped el comprobante fiscal que ampare los cobros realizados por concepto de Tarifa total del Hospedaje y servicios complementarios.

11. Proteger los datos personales del Huésped.

12. Hacer efectivo el seguro de responsabilidad civil con que cuente el Inmueble.

B. EL HUÉSPED SE OBLIGA A:

1. Exhibir documento oficial que demuestre su mayoría de edad, así como registrarse y registrar a sus acompañantes y visitantes en el Anexo A.

2. Acreditar con documento oficial, tener parentesco, tutela o guarda y custodia de menores de edad que lo acompañen y a registrarlos en el Anexo A.

3. Informar al Anfitrión, antes de realizar la Reservación, si pretende ingresar al Inmueble con mascotas, mismas que en todo caso están sujetas a los Términos y Condiciones establecidos en el presente Contrato.

4. Cumplir con el control de llegadas y salidas del Inmueble, incluyendo nombre, ocupación, origen, procedencia, lugar de residencia y datos de contacto para casos de emergencia, de todos los ocupantes de el inmueble.

5. Observar y hacer observar por sus acompañantes y visitas las normas de higiene y convivencia social.

6. No realizar actos contrarios a las normas, y no realizar conductas ofensivas o discriminatorias.

7. Respetar y hacer respetar por sus acompañantes y visitas el Reglamento del Inmueble.

8. Pagar la Tarifa total del Hospedaje en el modo establecido en la Reservación y a más tardar el día del Check-out, sin que haber presentado una reclamación exima del pago.

9. No solicitar con posterioridad, la cancelación o contracargo de los cargos legítimamente realizados por el Anfitrión, a su institución bancaria.

10. Respetar y hacer respetar por sus acompañantes y visitas el entorno natural, cultural e histórico, así como las costumbres, comportamientos y creencias del lugar.

11. Cumplir y hacer cumplir por sus acompañantes y visitas los términos y condiciones del presente Contrato.

12. Cubrir el pago del Impuesto Sobre el Hospedaje aplicable en la Ciudad de México, así como del Impuesto al Valor Agregado.

13. Cumplir con las restricciones o prohibiciones que aplican en el Inmueble.

14. Destinar el Inmueble exclusivamente para su uso habitacional, debiendo cuidarlo como propio.

15. No alterar el orden público ni afectar el interés social.

16. Permitir el acceso al Inmueble al Anfitrión o el personal a su cargo, para realizar labores de mantenimiento o limpieza del inmueble, o en casos de emergencia.

17. Permitir el acceso al Inmueble a personal autorizado por el Instituto de Verificación Administrativa, así como al personal de los cuerpos policiales en cumplimiento de una comisión.

18. Autorizar el cargo automático a través de la forma de pago preautorizada o mediante cualquier otra forma de pago, de todos los daños o pérdidas causados al Inmueble, su menaje, instalaciones o acabados, que sean debidamente comprobados de acuerdo con la depreciación del bien, y en caso contrario, a ser puesto a disposición de las autoridades por el delito que corresponda.

19. Cubrir los importes correspondientes por concepto de multas a las que se haga acreedor por incumplir los Términos y Condiciones del Contrato, o el Reglamento del Inmueble, conforme a los montos establecidos en la Lista de tarifas (Anexo C).

NOVENA.- REGLAMENTO DEL INMUEBLE.- Las partes convienen en que el uso de las instalaciones del Inmueble (además de lo estipulado en el presente Contrato), se sujeta a lo dispuesto en el Reglamento del Inmueble, documento que se agrega al presente Contrato como Anexo B, y que se encuentra a disposición del Huésped para su consulta y descarga, tanto en el Inmueble, como en el sitio web: : https://be.nowness-living.com/terms-and-conditions.

El Huésped reconoce que por el sólo hecho de hospedarse en el Inmueble acepta las reglas contenidas en el Reglamento, mismas que regulan el uso adecuado de las instalaciones del Inmueble, sin perjuicio de lo previsto en el presente Contrato.

DÉCIMA. POLÍTICAS DE CANCELACIÓN.- La cancelación de la Reservación es aplicable en cada caso concreto, atendiendo a la política de cancelación correspondiente, conforme a lo siguiente.

A. En los casos en que la Reservación haya sido confirmada a través de Plataformas Tecnológicas o por medio de Agencias de Viajes en Línea (OTAs) debidamente autorizadas, será aplicable la política de cancelación vigente en el medio correspondiente al momento de confirmarse la Reservación, debiendo realizarse la cancelación conforme al procedimiento indicado en el mismo.

B. Lo mismo resultará aplicable en el caso de que el Anfitrión se vea en la necesidad de cancelar la Reservación confirmada a través de alguno de esos medios, sin culpa del Huésped.

C. En los casos en que la Reservación haya sido confirmada directamente con el Anfitrión, o en defecto de cualquier otra política de cancelación aplicable, siempre que se realice por escrito y que los Servicios de Hospedaje no se hayan prestado al Huésped, resultará aplicable la siguiente política de cancelación:

1. Para recibir un reembolso completo, el Huésped debe cancelar por lo menos 30 días antes del Check-in.

2. Si cancela entre 15 y 30 días antes de la llegada, el Huésped recibirá el reembolso correspondiente al 50% de las noches reservadas.

3. Si cancela menos de 7 días antes de la llegada, el Huésped no recibirán reembolso alguno.

4. El Anfitrión tendrá la opción de ofrecer una fecha distinta al Huésped, sujeta a disponibilidad.

5. En caso de que la reservación esté sujeta a una promoción directa por parte del Anfitrión, el Huésped acepta que la tarifa no será reembolsable.

En el caso de Reservaciones que correspondan a estancias de larga duración, entendidas éstas como aquéllas con una duración de veintiocho (28) noches consecutivas o más, y salvo que exista otra política de cancelación acordada por escrito entre el Huésped y el Anfitrión, aplicará la siguiente política de cancelación:

1. Para que el Huésped reciba un reembolso completo, éste deberá cancelar su Reservación dentro de las cuarenta y ocho (48) horas siguientes a su realización, y dicha cancelación deberá efectuarse por lo menos treinta (30) días antes de la fecha del Check-in.

2. Si el Huésped cancela después del plazo señalado en el numeral anterior, el Anfitrión tendrá derecho a cobrar el 100% de las noches que el Huésped ya haya utilizado, más el monto correspondiente a las siguientes treinta (30) noches incluidas en la Reservación.

3. En caso de que al momento de la cancelación queden menos de treinta (30) noches pendientes en la Reservación, el Anfitrión tendrá derecho a cobrar el 100% de las noches restantes.

En estos casos el Anfitrión deberá dar contestación a la solicitud de cancelación del Huésped en un plazo de 120 (Ciento y Veinte) horas y a falta de respuesta se entenderá que la cancelación fue aceptada, sin perjuicio de las penalizaciones antes indicadas.

D. En los casos del inciso anterior, cuando el Anfitrión se vea en la necesidad de cancelar la Reservación, sin culpa del Huésped, estando cubierta la Tarifa total del Hospedaje, resultará aplicable la siguiente política de cancelación:

1. El Anfitrión deberá emitir un reembolso completo si cancela por lo menos 24 (Veinte y Cuatro) horas antes del Check-in.

2. Si cancela entre las 24 (Veinte y Cuatro) horas antes Check-in y el Check-in, el Anfitrión deberá emitir un reembolso completo o en su caso, podrá proporcionarle un servicio de Hospedaje similar al pactado, con las mismas condiciones y características.

3. Si cancela después del Check-in, el Anfitrión deberá emitir el reembolso correspondiente al 100% del precio de las noches que no se hayan disfrutado o, en su caso, podrá proporcionarle un servicio de Hospedaje similar al pactado, con las mismas condiciones y características.

E. En los casos en que el Huésped no se presente en el Inmueble el día del Check-in (“No show”), el Anfitrión estará autorizado para realizar el cobro del 100% de la Tarifa total del Hospedaje, con independencia de que el Huésped se presente después y sólo haga uso de parte de las noches reservadas.

DÉCIMA PRIMERA. CAUSAS DE RESCISIÓN.- Es causa de rescisión del presente Contrato, el incumplimiento por alguna de las partes de cualquiera de las restricciones u obligaciones establecidas a su cargo en el mismo.

En caso de rescisión de este Contrato por culpa de Huésped, éste no tendrá derecho a reembolso ni bonificación alguna, debiendo cubrir además los daños y perjuicios que se le hayan ocasionado al Anfitrión, mediante la forma de pago utilizada para cubrir o garantizar la Tarifa del Hospedaje y/o cualquier otra prestación debida o, en caso de ser insuficiente ésta, mediante cualquier otra forma de pago. En estos casos el Anfitrión estará autorizado para negarle el acceso al Inmueble o desalojar al Huésped.

En caso de rescisión del presente Contrato por culpa del Anfitrión, éste tendrá derecho a corregir el motivo de incumplimiento en un plazo de 72 (setenta y dos) horas, de lo contrario deberá emitir el reembolso correspondiente al 100% del precio de las noches efectivamente pagadas, que no se hayan disfrutado por el Huésped, o bien podrá ofrecerle la opción de un servicio adicional u Hospedaje Substituto, conforme a la Cláusula siguiente.

DÉCIMA SEGUNDA.- DÉCIMA SEGUNDA.- HOSPEDAJE SUSTITUTO.- En caso de que el Anfitrión no le proporcione al Huésped los Servicios de Hospedaje en las condiciones y especificaciones pactadas en el presente Contrato, el Huésped podrá optar entre recibir un servicio de Hospedaje similar al pactado, ofrecido por el Anfitrión, con las mismas condiciones, características y precio, o bien, rescindir el contrato en términos la Cláusula anterior.

La disponibilidad del Inmueble puede variar debido a necesidades operativas o de mantenimiento. El Anfitrión se reserva el derecho de asignarle al Huésped un alojamiento similar sin previo aviso si es necesario para optimizar su experiencia o por razones operativas.

Los cambios de alojamiento a petición o por error del Huésped, están sujetos a disponibilidad y previo pago de la diferencia tarifaria aplicable. El Anfitrión informará al Huésped a la brevedad posible sobre la disponibilidad y tarifa del nuevo alojamiento, en caso de solicitarlo, así como la diferencia tarifaria aplicable para cubrir la Reservación bloqueada, en su caso.

DÉCIMA TERCERA. CASO FORTUITO Y FUERZA MAYOR.- Se entiende por caso fortuito o causa de fuerza mayor, aquellos hechos o acontecimientos ajenos a la voluntad de las partes, siempre y cuando, dichos hechos o acontecimientos sean disruptivos, imprevisibles, irresistibles, insuperables, actuales y no provengan de alguna negligencia o culpa de alguna de las partes.

Cuando los Servicios de Hospedaje no sean prestados por caso fortuito o causa de fuerza mayor, el Huésped tendrá derecho al reembolso del 50% de los pagos efectivamente realizados directamente al Anfitrión. En caso de que los servicios de Hospedaje se hayan prestado parcialmente, el Huésped solo tendrá derecho a que se le reembolse el 50% de la parte proporcional a los servicios de Hospedaje no prestados.

Cuando el Huésped haya contribuido en forma alguna al caso fortuito o a la causa de fuerza mayor, que le impidiera total o parcialmente el uso o goce del Inmueble, se encontrará obligado al pago del 100% de la Tarifa total del Hospedaje.

DÉCIMA CUARTA.- PERROS DE ASISTENCIA Y DE COMPAÑÍA.- El Huésped podrá ingresar al Inmueble acompañado de un perro de asistencia, sin condición ni costo adicional, siempre que la necesidad de la asistencia sea notoria para cualquier persona o, en su defecto, únicamente si presenta documento reciente expedido por un profesional médico especializado, que incluya el número de su cédula profesional y la indicación de que la persona está bajo cuidado profesional por la condición que presenta y que requiere del perro para su asistencia.

En caso de que el Huésped no compruebe que el animal es un perro de asistencia, podrá ingresarlo al Inmueble como perro de compañía, sujeto a disponibilidad de espacio y cubriendo la tarifa adicional consultable en la Lista de tarifas (Anexo C). En todo caso, el perro deberá contar con cartilla de vacunación vigente para poder permitir su ingreso al Inmueble.

El perro deberá encontrarse en todo momento con correa o arnés y placa de identificacion en todos los espacios de acceso al público; y no podrá dejarse sólo en ningún momento, ni siquiera dentro del Inmueble, Las mascotas no están permitidas en camas o muebles, Prohibido bañar o asear a las mascotas en el lugar, Las necesidades de las mascotas deben ser atendidas fuera de la propiedad. El incumplimiento de este deber será causa especial de rescisión del Contrato.

En caso de que el perro dañe el Inmueble, su menaje, instalaciones o acabados, el Huésped deberá cubrir al Anfitrión el costo de limpieza, reparación o reposición correspondiente.

DÉCIMA QUINTA.- RESPONSABILIDAD CIVIL.- El Arrendador no será responsable en modo alguno por siniestros ocurridos en el Inmueble, ya sea por culpa o negligencia del Huésped, sus acompañantes y/o visitantes, o por caso fortuito o fuerza mayor; entre los cuales se incluyen de forma enunciativa, daños en sus personas o propiedades, o muerte accidental; así como daños al Inmueble y a terceros, en sus personas o propiedades.

DÉCIMA SEXTA.- AVISO DE PRIVACIDAD.- Ambas partes reconocen que previo a la firma del presente Contrato y en cumplimiento a lo dispuesto en la Ley Federal de Protección de Datos Personales en Posesión de los Particulares, el Anfitrión hizo del conocimiento del Huésped el procedimiento para ejercer los derechos de acceso, rectificación, cancelación y oposición al tratamiento de sus datos personales, mediante su aviso de privacidad consultable en el Inmueble y en el sitio web: : https://be.nowness-living.com/terms-and-conditions..

Sin perjuicio de lo anterior, el Huésped acepta y autoriza al Anfitrión a transferir sus datos personales a la Secretaría de Turismo de la Ciudad de México y demás autoridades competentes que así lo requieran, de conformidad con la Ley de Turismo de la Ciudad de México y demás disposiciones legales aplicables.

DÉCIMA SÉPTIMA.- CONTRATACIÓN POR MEDIOS ELECTRÓNICOS.- Las partes acuerdan que este Contrato y sus Anexos, las Reservaciones efectuadas a través de Plataformas Tecnológicas o por medio de OTAs, así como cualquier forma de manifestación del consentimiento, aprobación u otros documentos relacionados con el mismo, no requieren de firmas originales autógrafas para su validez, por lo que podrán ser firmados por medio del uso de firmas electrónicas o digitales, o bien mediante el uso de caracteres numéricos, alfanuméricos, huellas de voz, datos biométricos o de cualquier otra forma requerida para el acceso a las Plataformas Tecnológicas o sistemas de transmisión de datos, y que dichos medios alternativos de firma y los registros en donde sean aplicados los mismos, serán considerados como válidos para todos los efectos, incluyendo pero no limitado a la legislación civil, mercantil, administrativa y de protección al consumidor, así como a la NOM-151-SCFI-2016, con la misma fuerza y consecuencias que la firma autógrafa original de la parte firmante.

Si el Contrato o cualquier otro documento relacionado con el mismo es firmado por medios electrónicos o digitales, las Partes acuerdan que los formatos del Contrato y los demás documentos suscritos de tal modo, serán conservados y estarán a disposición de las Partes, por lo que convienen que toda la información intercambiada entre ambas para la celebración del presente Contrato será considerada como entregada en el momento en que la misma sea enviada, de conformidad con el sistema de transmisión de datos empleado, siempre y cuando exista confirmación de recepción.

DÉCIMA OCTAVA.- POLÍTICA DE PREAUTORIZACIÓN Y LIBERACIÓN DE FONDOS.- El Huésped acepta que al realizar su Reservación o durante el Check-in, es posible que se realice una preautorización en su tarjeta de crédito. Esta preautorización es una retención temporal de fondos que garantiza la disponibilidad de crédito para cubrir posibles cargos adicionales, como daños o consumos extra durante su estancia. La preautorización no es un cargo definitivo; los fondos no se retiran de la cuenta Huésped, pero sí se reducen temporalmente sus fondos disponibles.

Una vez finalizada la estancia y verificado que no existan adeudos, el Anfitrión solicitará la cancelación de la preautorización; esto liberará los fondos retenidos en la tarjeta de crédito del Huésped, restaurando su límite de crédito disponible. El tiempo que tarda en reflejarse la liberación de fondos depende exclusivamente de su institución bancaria, aunque generalmente, este proceso puede variar entre 24 a 72 horas. Sin embargo, algunos bancos pueden tardar más en actualizar su saldo disponible. Esta liberación no aparecerá como una transacción o reembolso en su estado de cuenta, simplemente notará que su línea de crédito o saldo disponible ha vuelto a la normalidad.

El Anfitrión le informará al Huésped sobre el proceso de preautorización al momento de su Reservación y/o Check-in, y estará disponible para responder cualquier pregunta o aclaración que necesite respecto a este proceso. Es responsabilidad del huésped proporcionar información precisa y actualizada de la tarjeta de crédito para evitar inconvenientes o demoras en el proceso de preautorización, así como el asegurarse de que su tarjeta de crédito tenga fondos o línea de crédito suficientes para cubrir el monto de la preautorización, en caso contrario el Anfitrión se reserva el derecho de cancelar la Reservación y negar el acceso al Huésped.

DÉCIMA NOVENA.- ACTIVIDADES ILÍCITAS.- El Huésped, sus acompañantes, visitas y/o los ocupantes del Inmueble, por su sólo uso, se obligan a ocuparlo única y exclusivamente para el objeto señalado en el presente Contrato, y en caso de incumplimiento aquellos serán los únicos responsables del uso que se le dé a dicho inmueble. Si se llegare a cometer algún delito en el Inmueble, aquellos serán los responsables directos ante las autoridades o tribunales competentes del fuero común o federal, deslindando desde este momento al Inmueble, al Anfitrión y/o propietarios, de toda responsabilidad.

El Huésped, sus acompañantes, visitas y/o los ocupantes del Inmueble se obligan a no poseer, consumir, utilizar o permitir en dicho inmueble el almacenamiento de armas de fuego, armas blancas, pólvora, explosivos, psicotrópicos, drogas de cualquier naturaleza, instrumentos para procesarlas y/o cualquier otro de naturaleza análoga que sirva o haya servido para cometer algún ilícito, o que sean instrumento o producto de éste, por lo que son y serán responsables directos en caso de que Inmueble, al Anfitrión y/o propietarios se vean involucrados por tales ilícitos, aceptando las partes que cualquier practica en contrario será causa de rescisión inmediata del presente Contrato y que se de intervención a las autoridades competentes.

El Huésped, sus acompañantes, visitas y/o los ocupantes del Inmueble, se obligan expresamente a sacar a salvo y en paz al Inmueble, al Anfitrión y/o propietarios, o sus representantes en caso de que dicho Inmueble se vea involucrado en cualquier procedimiento, incluyendo, pero sin limitar ante el Ministerio Público local o Federal por la aplicación de la “Ley de Extinción de Dominio para el Distrito Federal” o su correlativo Federal o de aplicación local.

En el supuesto de que el Huésped, sus acompañantes, visitas y/o los ocupantes del Inmueble lo destinen a otro fin distinto al señalado y por dicho motivo se llegue a aplicar la Ley de Extinción de Dominio, ya sea federal o local, aquellos se obligan a indemnizar al Anfitrión y/o propietarios del Inmueble, por la cantidad que resulte de aplicar el valor comercial que tuviere el Inmueble al momento de la declaratoria de extinción de dominio, debiendo de cubrir dicha indemnización a más tardar dentro de los 30 días siguientes a que se notifique la misma a el Anfitrión y/o propietarios del Inmueble.

De igual forma El Huésped, sus acompañantes, visitas y/o los ocupantes del Inmueble, se obligan a sacar salvo y en paz al Inmueble, al Anfitrión y/o propietarios, o sus representantes, en caso de que por su culpa se inicie algún procedimiento de infracción a la Ley De Cultura Cívica de la Ciudad De México o la Ley de Establecimientos Mercantiles de la Ciudad de México, obligándose además a pagar los gastos y honorarios de abogados, así como la reparación del daño causado. Es obligación de El Huésped, sus acompañantes, visitas y/o los ocupantes del Inmueble, el informar de forma inmediata a el “Anfitrión y/o propietarios, o sus representantes, sobre cualquier notificación, procedimiento o juicio seguido en su contra.

VIGESIMA.- POLÍTICA AMBIENTAL.- El Anfitrión se compromete con la protección de los derechos de la naturaleza conformada por todos sus ecosistemas y especies como un ente colectivo sujeto de derechos. En consecuencia, promoverá el cuidado y el aprovechamiento sustentable de los recursos naturales, teniendo el Huésped la obligación de hacer un uso eficiente y sustentable de los mismos.

El Huésped desarrollará sus actividades evitando generar algún tipo de contaminación y afectar la salud, la calidad del aire, el clima, la conservación del medio ambiente, la protección ecológica o provocar daños al ambiente, la biodiversidad y los recursos naturales.

El Anfitrión establecerá una política de manejo integral de los residuos acorde con las normas ambientales para la Ciudad de México, teniendo en cuenta el aprovechamiento sustentable del agua y el tratamiento de aguas residuales provenientes de sus actividades.

VIGÉSIMA PRIMERA. RESPONSABILIDAD FRENTE AL ANFITRIÓN.- En todo caso, el Huésped deberá resarcir de los daños y perjuicios, que el propio Huésped, sus acompañantes o visitas ocasionen al Anfitrión en su persona o patrimonio, o a los de terceros; ya sea por su dolo, mala fe, culpa o negligencia; incluyendo aquellos ocasionados por difamación o calumnias, así como por cualquier afectación en la operación y flujo del negocio, o competencia desleal.

VIGÉSIMA SEGUNDA. RESOLUCIÓN DE DISPUTAS.- Para todo lo relativo a la interpretación, aplicación y cumplimiento del presente Contrato, las Partes acuerdan resolver sus disputas mediante una amigable composición; en caso que no sea posible conciliar de común acuerdo, acuerdan someterse a la mediación de las Plataformas Tecnológicas o la OTAs mediante las cuales se haya confirmado la Reservación; y sólo en caso de que mediante este mecanismo no se logre la conciliación entre la partes, éstas convienen en someterse al arbitraje de la Procuraduría Federal del Consumidor, con sede en la Ciudad de México, y sólo en caso de subsistir diferencias, acuerdan someterse a la jurisdicción de los Tribunales competentes de la Ciudad de México.

Las Partes manifiestan haber leído el presente Contrato y sus Anexos, así como estar de acuerdo con todos sus Términos y Condiciones, por lo que mediante la confirmación de la Reservación, la suscripción de la Hoja de registro (Anexo A) o el uso del Inmueble, indistintamente, otorgan su consentimiento para obligarse de común acuerdo conforme al mismo, en la Ciudad de México, en la fecha en que se actualice cualquiera de dichos supuestos. LAS PARTES.

TERMS AND CONDITIONS OF THE CONTRACT FOR LODGING SERVICES AND TEMPORARY TOURIST STAY, HEREINAFTER REFERRED TO AS "THE CONTRACT," ENTERED INTO BY AND BETWEEN NOWNESS SA DE CV, HEREINAFTER REFERRED TO AS "THE HOST," AND ON THE OTHER HAND, "THE GUEST," AS INDICATED IN THE "RESERVATION," AS DEFINED BELOW AND WHICH FORMS AN INTEGRAL PART OF THIS CONTRACT. COLLECTIVELY, THEY SHALL BE REFERRED TO AS "THE PARTIES," UNDER THE FOLLOWING DECLARATIONS AND CLAUSES:

DECLARATIONS

I. "The Host" declares that:

a) It is a legal entity duly constituted under Mexican law, as evidenced by public deed number 93,031 (NINETY-THREE THOUSAND THIRTY-ONE), dated 11/09/2022, executed before Notary Public No. 29 of Mexico City, LUIS ANTONIO MONTES DE OCA MAYAGOITIA, and registered with the Public Registry of Commerce of Mexico City under number A202208171221577250, dated 22/12/2022. Yosef Zonana, in his capacity as legal representative, acts in this agreement under the powers granted to him in public deed number 93,031 (NINETY-THREE THOUSAND THIRTY-ONE), dated 11/09/2022, executed before Notary Public No. 29 of Mexico City, LUIS ANTONIO MONTES DE OCA MAYAGOITIA. Said powers have not been revoked, modified, or limited as of the date of execution of this Contract.

b) Its corporate purpose includes the provision, either directly or through third parties, of Lodging Services and Temporary Tourist Stay services in residential-use properties, whether houses, entire buildings, or their individual rooms or apartments (hereinafter, individually referred to as the "Property").

c) Its address is located at https://be.nowness-living.com/terms-and-conditions, where it provides the Lodging Services and Temporary Tourist Stay services subject to this Contract (hereinafter collectively referred to as the "Lodging Services"), which it designates as its conventional domicile for all purposes of this instrument.

d) It is registered with the Federal Taxpayers Registry under the code NOW220913GG4.

e) The Property has safe and hygienic facilities and meets the necessary conditions and supplies to provide the Lodging Services, including personnel trained to address incidents related to acts of discrimination.

f) It is prohibited to deny, exclude, or differentiate access to services or their provision to any person or social group based on skin tone, ethnic origin, nationality, race, language, sex, gender, age, disability, legal, social, or economic status, indigenous identity, gender identity, physical appearance, health conditions, religion, ideology, sexual orientation or preference, tattoos, piercings, or any other reason intended to prevent the enjoyment and exercise of human rights.

g) To address any request or complaint from the Guest, it provides the telephone number +52 5618738646 and the email address nowness.living@gmail.com, with service hours from 07:00 to 23:00 hours.

h) Additionally, for complaints, reports, and emergencies, the Guest may contact the competent authorities through the following means:

• Emergencies: Telephone: 911 (24-hour service).

• Government of Mexico City Accredited Telephone Assistance: LOCATEL. Telephone: 55-5658-1111 (24-hour service).

• Mexico City Administrative Verification Institute: Telephone: 55-4737-7700. Email: atencion.invea@cdmx.gob.mx. Service hours: Monday to Thursday from 9:00 to 18:00 hours; Friday from 9:00 to 15:00 hours.

i) It has informed the Guest of the characteristics and rates of the Lodging Services, including complementary services, as well as the applicable Lodging Tax rate in Mexico City.

j) It has made available to the Guest the terms and conditions of this Contract, as well as the Rules or Regulations governing the use of the Property (hereinafter referred to as the "Property Regulations"). These documents are available for consultation and download at the Property and on the website: https://be.nowness-living.com/terms-and-conditions.

k) It will protect and handle the Guest’s personal data solely for the purpose of providing the Lodging Services and in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties. For more information regarding the handling and protection of personal data, the privacy notice is available at the Property and on the website: https://be.nowness-living.com/terms-and-conditions.

II. "The Guest" declares that:

a) They are a natural person with the legal and financial capacity to enter into this Contract and possess an official document proving their legal age.

b) Their occupation, origin, and place of residence are stated in the "Reservation," as defined below.

c) They formally declare under oath that they have a family relationship, legal guardianship, or custody of any accompanying minors (if applicable), as evidenced by an appropriate document.

d) The Property has safe and hygienic facilities and meets the necessary conditions and supplies for lodging.

e) They are fully aware of the characteristics, facilities, location, size, capacity, condition, accessories, services, and common areas of the Property.

f) They acknowledge the rates of the Lodging Services provided by the Host at the Property, including complementary services.

g) They are aware of the applicable tax rates, including the Lodging Tax in Mexico City, and accept them.

h) They acknowledge the terms and conditions set forth in this Contract, as well as the Property Regulations, and affirm that they have read and have access to these documents.

i) They acknowledge the treatment and protection of their personal data provided by the Host.

CLAUSES

FIRST: CONSENT

By confirming the Property reservation, whether directly or through third parties, via Technology Platforms or Online Travel Agencies (OTAs) duly authorized, or by booking directly with the Host, or simply by signing the Property Registration Form (Annex A), hereinafter referred to as the "Reservation," the parties express their willingness to be bound by this Contract. The Host agrees to provide the Property to the Guest in accordance with the terms of the Reservation, and the Guest, in turn, agrees to pay the applicable and determined price at the time of booking and to comply with all the terms and conditions of this Contract.

All persons lodging in the Property, regardless of whether the Reservation was made by a third party, are subject to all the Terms and Conditions of this Contract and are considered Guests individually. They shall be jointly responsible with the person who made the Reservation for complying with all obligations set forth in this Contract.

SECOND: PURPOSE

The purpose of this Contract is the provision of Lodging Services and Temporary Tourist Stay at the Property (“Lodging Services”) by the Host in favor of the Guest. The characteristics and variable rates, in accordance with market prices, are indicated in publicly available listings on the websites and applications of Technology Platforms and OTAs, as well as in the Rate List (Annex C), which forms an integral part of this Contract and is available to the public and the Guest at the Property and on the website: https://be.nowness-living.com/terms-and-conditions.

THIRD: LODGING RATE

The parties agree that the price to be paid by the Guest for the Lodging Services is the price informed at the time of confirming the Reservation or any authorized modification by the Host. In the absence of such confirmation, the price shall be that listed in the Rate List (Annex C) available to the Guest (the "Lodging Rate").

FOURTH: PAYMENT METHOD AND PLACE

The Guest shall pay the Lodging Rate in national currency, in the time and manner stipulated in the Reservation, through the payment systems of Technology Platforms or OTAs, or directly to the Host at the Property no later than the day of departure (“Check-out”).

The Guest authorizes the Host to perform a funds hold or pre-authorization on their debit or credit card on the day of arrival (“Check-in”) to guarantee payment of the Lodging Rate, in case they have not already provided proof of payment, as well as for a deposit to guarantee payment of additional Lodging Services and complementary services that may be requested during their stay, and to cover any potential damages to the Property.

In the event that the Guest fails to provide proof of payment of the Lodging Rate on the day of Check-in or does not guarantee it in any way during their stay, the Host shall be authorized to cancel the Reservation and deny access to the Property or proceed with the Guest’s eviction.

The Guest may make the required deposit in cash on the day of Check-in if they do not have another payment method or if the chosen method is insufficient. The refund or release of this deposit shall be subject to the Host’s verification that there are no outstanding payments or damages to be covered.

No later than the Check-out date, the Guest must have fully paid the total Lodging Rate and the cost of all complementary services.

The Guest shall not, under any circumstances, withhold or condition the payment of the Lodging Rate, complementary services, or any other accrued service, for any reason or under any title. Upon the due date of payment, it shall be understood that the Host has made the corresponding payment request to the Guest, in a timely and proper manner, for all legal purposes.

A delay in payment of any obligation by the Guest shall incur default interest at a rate of 0.5% per day on the outstanding balance until full settlement (the “Surcharges”).

If the Host incurs any banking commission due to the payment method chosen by the Guest, such cost must be fully covered by the Guest.

If there is any outstanding balance owed by the Guest, the Host may apply the deposit to cover it, to the extent of the deposit amount, without prejudice to the Guest’s obligation to pay any remaining balance.

In the event of the Guest’s refusal to pay, the Host is prohibited from physically detaining the Guest and must immediately request intervention from the competent authorities. In accordance with Article 2669 of the Civil Code for Mexico City, the Host may retain the Guest’s luggage as a pledge until the outstanding amount is paid.

FIFTH: GUEST CHECK-IN AND CHECK-OUT

The Host shall deliver the Property to the Guest between 16:00 (sixteen) hours and no later than 18:00 (eighteen) hours on the day of arrival (“Check-in”), and the Guest must vacate the room no later than 10:00 (ten) hours on the departure day (“Check-out”).

The Guest is entitled to a grace period of 60 (sixty) minutes from the check-out time to vacate the Property without charge. Otherwise, the Guest shall cover the applicable rate for that night or any additional nights occupied, in accordance with the Rate List (Annex C).

In any case, the Guest agrees that the Host may automatically charge the registered Payment Method for the additional night(s) once the grace period has elapsed, notwithstanding the security deposit made.

SIXTH: COMPLEMENTARY AND EXTERNAL SERVICES

As a complement to the Lodging Services, the Host may provide the Guest, at the Property, with complementary services listed in the Complementary Services Price List (Annex D), available for consultation at the Property and on the website: https://be.nowness-living.com/terms-and-conditions.

These services, subject to availability, may include but are not limited to:

• Food and beverage sales,

• Cleaning, laundry, or ironing services,

• Hairdressing or spa services,

• Office or coworking services,

• Event or entertainment services,

• Other similar services.

These must be expressly authorized by the Guest in Annex A.

External services provided by third parties, such as:

• Travel agency services,

• Tours or tourist guides,

• Courier or delivery services,

• Car rentals, taxis, or shuttles,

• Other similar services promoted by the Host under commercial collaborations,

are the exclusive responsibility of the respective service providers. The Guest must explicitly authorize and pay for these services directly to the external providers in accordance with their own terms and conditions. The Host disclaims any responsibility related to these external services.

SEVENTH: RESTRICTIONS

The Host shall ensure the safety of individuals and shall not allow the Property to be used for activities that disturb public order, affect social interest, or facilitate the commission of any crime. In such cases, the Host must notify the relevant authorities.

As a result, the following are strictly prohibited:

1. The entry of minors into the Property without being accompanied by an individual who can prove a familial relationship, guardianship, or custody, and who has not been duly registered.

2. The entry of pets into the Property, except for assistance or service dogs, subject to availability.

3. The entry of any type of weapon into the Property.

4. Generating noise that affects third parties.

5. Exceeding the maximum occupancy capacity of the Property.

6. Smoking inside the Property and in all enclosed public-access areas.

7. Gambling within the Property.

8. Engaging in activities related to prostitution, pornography, sex work, drug use or trafficking, crimes against public health, corruption of minors, sex tourism, or human trafficking for sexual exploitation.

9. Recording or filming commercial content, videos, or photographs within the Property.

10. Damaging, modifying, altering, or interfering in any way with the Property, its facilities, finishes, or furnishings.

EIGHTH: OBLIGATIONS OF THE PARTIES

A. THE HOST UNDERTAKES TO:

1. Confirm the Guest’s Reservation, after informing them of the characteristics and rates of the Lodging Services, as well as any complementary services.

2. Inform the Guest of the terms and conditions set forth in this Contract and comply with them.

3. Inform the Guest about the applicable Lodging Tax in Mexico City.

4. Inform the Guest of the Property Regulations.

5. Notify the Guest of any restrictions or prohibitions that apply within the Property.

6. Not discriminate against the Guest in any manner.

7. Address complaints, reports, and claims from the Guest.

8. Allow access to the Property for personnel authorized by the Administrative Verification Institute, as well as law enforcement personnel carrying out official duties.

9. Allow access to the Property for service dogs.

10. Issue and provide the Guest with an official receipt for the total Lodging Rate and complementary services charged.

11. Protect the Guest’s personal data.

12. Enforce the civil liability insurance coverage applicable to the Property.

B. THE GUEST UNDERTAKES TO:

1. Present an official document proving their legal age and register themselves, their companions, and visitors in Annex A.

2. Provide official documentation proving familial relationship, guardianship, or custody of any accompanying minors and register them in Annex A.

3. Inform the Host, before making a Reservation, if they intend to bring pets, which shall, in any case, be subject to the terms and conditions of this Contract.

4. Comply with the Property’s check-in and check-out procedures, including providing information such as name, occupation, origin, place of residence, and emergency contact details for all occupants.

5. Observe and ensure their companions and visitors observe hygiene and social coexistence norms.

6. Refrain from engaging in any unlawful activities and from engaging in offensive or discriminatory conduct.

7. Respect and ensure their companions and visitors respect the Property Regulations.

8. Pay the total Lodging Rate as per the Reservation terms and no later than the Check-out date, understanding that filing a claim does not exempt them from payment.

9. Refrain from requesting a chargeback or cancellation of valid charges made by the Host to their financial institution.

10. Respect the natural, cultural, and historical surroundings, as well as the customs, behaviors, and beliefs of the location.

11. Comply with and ensure their companions and visitors comply with the terms and conditions of this Contract.

12. Cover the payment of the Lodging Tax applicable in Mexico City, as well as the Value Added Tax (VAT).

13. Comply with the restrictions or prohibitions applicable to the Property.

14. Use the Property exclusively for residential purposes, taking care of it as if it were their own.

15. Not disturb public order or affect social interest.

16. Allow access to the Property by the Host or its personnel to perform maintenance or cleaning tasks, or in cases of emergency.

17. Allow access to the Property by personnel authorized by the Administrative Verification Institute, as well as law enforcement personnel performing official duties.

18. Authorize automatic charges through the preauthorized payment method or any other form of payment for all damages or losses caused to the Property, its furnishings, facilities, or finishes, which are duly verified according to the depreciation of the asset. Otherwise, the Guest may be reported to the authorities for the corresponding offense.

19. Cover any amounts due for fines incurred due to non-compliance with the Terms and Conditions of the Contract or the Property Regulations, according to the amounts established in the Rate List (Annex C).

NINTH: PROPERTY REGULATIONS

The Parties agree that the use of the Property’s facilities (in addition to the provisions of this Contract) is subject to the Property Regulations, a document attached to this Contract as Annex B, which is available for consultation and download at the Property and on the website: https://be.nowness-living.com/terms-and-conditions.

The Guest acknowledges that by staying at the Property, they accept the rules contained in the Property Regulations, which regulate the proper use of the facilities, without prejudice to the provisions of this Contract.

TENTH: CANCELLATION POLICIES

The cancellation of the Reservation shall be applicable in each specific case, subject to the corresponding cancellation policy, as follows:

A. Cancellations via OTAs or Online Platforms

1. If the Reservation was confirmed through Technology Platforms or Online Travel Agencies (OTAs), the cancellation policy in force on the respective platform at the time of confirmation shall apply.

2. The cancellation must be made following the procedure indicated on the respective platform.

B. Cancellations by the Host via OTAs

1. If the Host needs to cancel a Reservation confirmed through OTAs, without the Guest’s fault, the same cancellation policy will apply.

C. Direct Reservations with the Host

If the Reservation was confirmed directly with the Host, or if no other cancellation policy applies, the following conditions shall apply:

1. A full refund will be granted if the Guest cancels at least 30 days before Check-in.

2. If canceled between 15 and 30 days before arrival, the Guest will receive a 50% refund of the reserved nights.

3. If canceled less than 7 days before arrival, no refund will be issued.

4. The Host may offer an alternative date for the Guest, subject to availability.

5. If the Reservation was made under a direct promotion from the Host, the Guest agrees that the rate is non-refundable.

Long-Term Stay Cancellations (28+ Nights)

For long-term stays (28 consecutive nights or more), unless a different cancellation policy has been agreed upon in writing, the following applies:

1. To receive a full refund, the Guest must cancel within 48 hours of booking, provided that the cancellation occurs at least 30 days before Check-in.

2. If canceled after this 48-hour window, the Host is entitled to charge 100% of the nights already used, plus the amount corresponding to the next 30 nights of the Reservation.

3. If fewer than 30 nights remain at the time of cancellation, the Host is entitled to charge 100% of the remaining nights.

The Host must respond to the Guest’s cancellation request within 120 hours (five days). If no response is provided, the cancellation shall be deemed accepted, without prejudice to the penalties stated above.

E. No-Show Policy

If the Guest does not show up on the Check-in date (No Show), the Host is authorized to charge 100% of the Total Lodging Rate, regardless of whether the Guest arrives later and only uses a portion of the reserved nights.

ELEVENTH: TERMINATION OF CONTRACT

This Contract may be terminated if either party fails to comply with the restrictions or obligations assigned to them herein.

A. Termination Due to Guest’s Fault

• If termination is due to the Guest’s fault, they shall not be entitled to any refund or compensation and must cover any damages incurred by the Host.

• The Host is authorized to deny access to the Property or evict the Guest.

B. Termination Due to Host’s Fault

• If termination is due to the Host’s fault, they shall have 72 hours to rectify the issue.

• If not rectified, the Host must issue a 100% refund for the unused nights or offer an alternative lodging service of equal value.

TWELFTH: SUBSTITUTE LODGING

If the Host cannot provide the Lodging Services under the agreed conditions, the Guest may:

1. Accept alternative lodging of equal value, or

2. Terminate the Contract and receive a refund as per the previous clause.

The availability of the Property may change due to operational or maintenance needs. The Host reserves the right to assign the Guest an alternative lodging without prior notice, if necessary for operational efficiency.

If the Guest requests a change of lodging, this will be subject to availability and the applicable rate difference.

THIRTEENTH: FORCE MAJEURE AND UNFORESEEN EVENTS

A force majeure event refers to any unforeseeable, unavoidable, and external event that prevents the provision of Lodging Services.

1. If services cannot be provided due to force majeure, the Guest is entitled to a 50% refund of payments made directly to the Host.

2. If services have been partially rendered, the Guest is entitled to a 50% refund of the unused portion.

3. If the Guest’s actions contributed to the force majeure event, they shall be liable for 100% of the Total Lodging Rate.

FOURTEENTH: SERVICE AND COMPANION DOGS

The Guest may bring a service dog into the Property at no additional cost, provided that:

1. The need for assistance is obvious, or

2. The Guest provides recent medical documentation from a licensed medical professional confirming the necessity of the service dog.

If the Guest cannot provide proof that the animal is a service dog, it may be admitted into the Property as a companion dog, subject to availability and payment of the additional fee listed in the Rate List (Annex C). In any case, the dog must have an up-to-date vaccination record to be allowed entry into the Property.

The dog must always be kept on a leash or harness and wear an identification tag in all public access areas. It may not be left alone at any time, even inside the Property. Pets are not allowed on beds or furniture. Bathing or grooming pets within the Property is strictly prohibited. Pet waste must be disposed of outside the Property.

Failure to comply with these obligations shall be a special cause for termination of this Contract.

If the dog causes damage to the Property, its furnishings, facilities, or finishes, the Guest must cover the cost of cleaning, repair, or replacement accordingly.

FIFTEENTH: CIVIL LIABILITY

The Host shall not be liable for any incidents occurring within the Property, whether due to the fault or negligence of the Guest, their companions, and/or visitors, or due to force majeure or unforeseen events. This includes, but is not limited to, damage to persons or property, accidental death, as well as damage to the Property and third parties, their persons, or property.

SIXTEENTH: PRIVACY NOTICE

Both Parties acknowledge that prior to signing this Contract, and in compliance with the Federal Law on the Protection of Personal Data Held by Private Parties, the Host has informed the Guest of the procedure for exercising their rights of access, rectification, cancellation, and objection regarding the processing of their personal data. The privacy notice is available for consultation at the Property and on the website: https://be.nowness-living.com/terms-and-conditions.

Notwithstanding the above, the Guest expressly accepts and authorizes the Host to transfer their personal data to the Mexico City Ministry of Tourism and any other competent authorities that may require it, in accordance with the Mexico City Tourism Law and other applicable legal provisions.

SEVENTEENTH: CONTRACTING THROUGH ELECTRONIC MEANS

The Parties agree that this Contract and its Annexes, Reservations made through Technology Platforms or OTAs, as well as any form of consent, approval, or related documents, do not require handwritten signatures for validity.

They may be signed using electronic or digital signatures, numerical or alphanumeric characters, voiceprints, biometric data, or any other form required for accessing Technology Platforms or data transmission systems. These alternative signature methods and the records in which they are applied shall be legally valid for all purposes, including, but not limited to, civil, commercial, administrative, and consumer protection laws, as well as NOM-151-SCFI-2016, with the same force and consequences as the original handwritten signature of the signing party.

If the Contract or any related document is signed electronically or digitally, the Parties agree that the Contract formats and other digitally signed documents shall be stored and made available to both Parties. They further agree that all information exchanged for the execution of this Contract shall be considered delivered at the moment it is sent, in accordance with the data transmission system used, provided that a receipt confirmation exists.

EIGHTEENTH: PRE-AUTHORIZATION AND FUND RELEASE POLICY

The Guest acknowledges that upon making a Reservation or during Check-in, a pre-authorization may be performed on their credit card. This pre-authorization is a temporary hold of funds that ensures the availability of credit to cover additional charges, such as damages or extra charges incurred during their stay.

The pre-authorization is not a final charge; funds are not withdrawn from the Guest’s account, but their available balance is temporarily reduced.

Once the stay is completed and it is verified that there are no outstanding balances, the Host will request the cancellation of the pre-authorization, releasing the held funds and restoring the Guest’s available credit limit.

The time for the fund release to reflect in the Guest’s account depends solely on their bank, typically ranging between 24 and 72 hours. However, some banks may take longer to update the available balance.

This release will not appear as a transaction or refund in the Guest’s account statement; they will simply notice that their credit line or available balance has returned to normal.

The Host shall inform the Guest about the pre-authorization process at the time of Reservation and/or Check-in, and shall be available to answer any questions or clarifications regarding this process.

The Guest is responsible for providing accurate and up-to-date credit card information to avoid delays or issues with the pre-authorization process. Additionally, the Guest must ensure that their credit card has sufficient funds or credit to cover the pre-authorization amount.

If the Guest fails to provide a valid payment method, the Host reserves the right to cancel the Reservation and deny access to the Guest.

NINETEENTH: ILLEGAL ACTIVITIES

The Guest, their companions, visitors, and/or occupants of the Property shall use it exclusively for the intended purpose under this Contract. Any violation shall render them solely responsible for any misuse of the Property.

If any crime is committed within the Property, the responsible individuals shall be directly accountable to the authorities or competent courts, whether local or federal, absolving the Property, the Host, and/or the owners of all liability.

The Guest, their companions, visitors, and/or occupants expressly agree not to possess, consume, use, or store in the Property any of the following:

• Firearms, knives, gunpowder, explosives

• Psychotropic substances or drugs of any nature

• Instruments for drug processing

• Any illegal items or products related to crimes

Any violation of this provision shall be cause for immediate termination of this Contract, and the competent authorities shall be notified.

The Guest, their companions, visitors, and/or occupants shall indemnify and hold harmless the Property, the Host, and/or the owners in case the Property becomes involved in any legal proceeding, including, but not limited to, those related to the Asset Forfeiture Law at the local or federal level.

If the Guest’s actions result in the application of the Asset Forfeiture Law, they shall be liable to indemnify the Host and/or owners for the full commercial value of the Property at the time of forfeiture. This indemnity must be paid within 30 days of notification.

NINETEENTH: ILLEGAL ACTIVITIES

The Guest, their companions, visitors, and/or occupants of the Property shall use it exclusively for the intended purpose under this Contract. Any violation shall render them solely responsible for any misuse of the Property.

If any crime is committed within the Property, the responsible individuals shall be directly accountable to the authorities or competent courts, whether local or federal, absolving the Property, the Host, and/or the owners of all liability.

The Guest, their companions, visitors, and/or occupants expressly agree not to possess, consume, use, or store in the Property any of the following:

• Firearms, knives, gunpowder, explosives

• Psychotropic substances or drugs of any nature

• Instruments for drug processing

• Any illegal items or products related to crimes

Any violation of this provision shall be cause for immediate termination of this Contract, and the competent authorities shall be notified.

The Guest, their companions, visitors, and/or occupants shall indemnify and hold harmless the Property, the Host, and/or the owners in case the Property becomes involved in any legal proceeding, including, but not limited to, those related to the Asset Forfeiture Law at the local or federal level.

If the Guest’s actions result in the application of the Asset Forfeiture Law, they shall be liable to indemnify the Host and/or owners for the full commercial value of the Property at the time of forfeiture. This indemnity must be paid within 30 days of notification.

TWENTIETH: ENVIRONMENTAL POLICY

The Host is committed to environmental protection, promoting sustainable resource use. The Guest must efficiently and sustainably use natural resources and avoid environmental harm.

The Host will implement a waste management policy aligned with Mexico City’s environmental regulations, including water conservation and wastewater treatment.

TWENTY-FIRST: LIABILITY TOWARD THE HOST

The Guest shall be liable for any damages caused to the Host, their property, third parties, or business operations, whether through intent, bad faith, negligence, or defamation.

TWENTY-SECOND: DISPUTE RESOLUTION

In case of disputes, the Parties agree to first attempt amicable settlement. If unresolved, they will submit to mediation via the Technology Platforms or OTAs.

If mediation fails, they agree to arbitration by Mexico’s Consumer Protection Agency (PROFECO) and, if necessary, submit to the competent courts of Mexico City.
